The College Council is established in accordance with Article 1 of the Law on Vocational Education and specific regulations as follows:
1. Duties:
a) Annually or when necessary, reporting and explaining to the Provincial People's Committee and the Ministry of Labor, War Invalids and Social Affairs on vocational education, conditions ensuring quality, activities results, implementation of commitments, and finances of the college;
b) Recommending to the competent authorities to approve plans for supplementation, dismissal, resignation, or replacement of members of the school council;
c) Approving regulations on the quantity, structure of labor, employment positions; recruitment, management, utilization, and development of lecturers, management officials, civil servants, and employees of the college;
d) Introducing personnel to implement the appointment procedure of the Rector, Vice Rectors; conduct annual evaluations of the performance of the Rector, Vice Rectors; recommending to the competent authorities dismissal, resignation of the Rector, Vice Rectors; organizing confidence voting for the Rector, Vice Rectors mid-term or when necessary;
e) Requiring the Rector to explain issues that have not been implemented, improperly implemented, or incompletely implemented according to the resolutions of the College Council. If the College Council does not agree with the Rector's explanation, report to the college’s management agency.
2. Activities:
a) The College Council convenes regular meetings at least once every 3 (three) months, and emergency meetings when requested in writing by over 30% of the total members of the College Council or when requested in writing by the Rector or the Chairperman of the College Council.
The College Council meeting is valid when at least 70% of the total members of the College Council attend. The College Council operates on a collective basis and decides by majority vote. Resolutions of the College Council are valid when over 50% of the total members of the College Council agree. In case of a tie, the final decision belongs to the opinion of the Chairperman of the College Council. The minutes of College Council meetings must be recorded. The meeting minutes and resolutions of the College Council are sent to the members of the College Council, the college's management agency no later than 10 working days from the date of the meeting or the date the resolutions are passed.
b) The term of the College Council is 5 years and follows the term of the Rector. The College Council uses its own seal, organizational apparatus to implement the tasks of the College Council within the functions, tasks, and powers of the College Council;
c) Delegating the operation of the College Council
When the Chairman of the College Council cannot work within the specified time frame according to the organization and operation regulations of the college responsibility must be delegated in writing to one of the remaining members of the College Council to assume the responsibilities of the Chairman of the College Council. The delegation document must be notified to the members of the College Council, sent to the collegel's management agency, and publicly announced throughout the college. The delegation period does not exceed 6 (six) months.
3. The College Council has an odd number of members, including 01 chairperman, 01 secretary, and members. Participation criteria in the College Council are regulated in Article 3 of Article 11 of the Law on Vocational Education.
If representatives of production, business, and related services participate in the College Council, they must meet the following requirements:
a) Operating in the fields of training, science, technology, production, business, and services related to the functions, tasks of the college;
b) Being unrelated by blood, marriage, or direct familial relationships to other members of the College Council.
4. Members:
a) The College Council has an odd number of members, at least 15 members, including officio members, appointed members, and elected members.
b) Officio members include the Rector, Vice Rectors, Party Committee Secretary, Trade Union Chairman, and Ho Chi Minh Communist Youth Union Secretary.
c) Appointed members are representatives of state management agencies, enterprises, alumni, scientists, management and education development experts. The number of appointed members is from 4-6 members.
d) Elected members represent the group of lecturers, management officials, political-social organizations within the college, and student representatives. The number of elected members is from 3-5 members.
e) The Chairman of the College Council represents the direct management agency of the college. The standards of the Chairman of the College Council are the same as those of the Rector.
f) The Secretary of the College Council is introduced by the Chairman of the College Council among the members of the College Council and approved by the College Council with over 50% of the total members of the College Council agreeing. The Secretary of the College Council does not concurrently hold the position of Rector or Vice Rector.
5. Duties of the Chairman:
a) Convening College Council meetings;
b) Deciding on the agenda, chairing meetings, and organizing voting at College Council meetings;
c) Directing the College Council to perform tasks, powers according to regulations in Article 2 of Article 11 of the Law on Vocational Education and provisions in this Article.
6. The Secretary of the College Council directly assists the Chairman of the College Council in performing the following tasks:
a) Summarizing, report to the Chairman of the College Council the activities of the College; preparing meeting agendas, content, documents, sending meeting invitations, and keeping minutes of College Council meetings; building, completing, and archiving documents of the College Council;
b) Preparing reports, explanation to state management agencies and related agencies according to the functions, duties of the College Council;
c) Performing other tasks assigned by the Chairman of the College Council.
7. Members of the College Council are responsible for performing tasks assigned by the College Council and other tasks stipulated in the regulations on the organization, operation of the College Council.
The procedures for establishing the College Council; appointing, dismissing, resigning, and discharging the chairperson and members of the college council are carried out in accordance with Article 11 of the College's Statute issued together with Circular No. 46/2016/TT-BLĐTBXH dated on December 28th , 2016, of the Ministry of Labor, War Invalids, and Social Affairs.
During the waiting period for the establishment and operation of the College Council, the college establishes a Divisional Council to implement some tasks of the College Council.
